TERMS & CONDITIONS
This is an Agreement between you (the Member) and A1 Thornaby Limited (t/a) allGym 8 New Street, Thornaby, Stockton-On-Tees, Durham, TS17 6BU Registered in England No. 12239035.
PRINCIPLE TERMS
This agreement is between you and A1 Thornaby Limited (t/a) allGym. This agreement commences once you have indicated your acceptance in the joining process. If you did not join on the clubs premises you have 14 full days after joining (or 14 full days from when your chosen club opens, if you joined during a pre-opening sales phase) to cancel this agreement for any reason. To exercise this right you must inform allGym by using the cancellation option in your allGym app or by visiting the allGym website and submitting a cancellation form.
If you exercise this right to cancel we (allGym) will reimburse you all joining and membership fee payments received from you. If you have used the service before requesting to cancel then we (allGym) will reduce your membership fee refund by a pro rata amount equal to the number of days from joining to the date cancellation was requested.
If you joined on our trade premises you have no legal entitlement to a cooling-off period.
Your membership starts immediately (or when your club opens in the case of a pre-sale membership).
You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen. Memberships are not transferable to another person or branch.
FEES AND CHARGES
The Monthly Payment Amount is due from you to us (allGym). You are obligated to make the Minimum No. of Monthly Payments stated with the first one being paid on the First Monthly Payment Date and then every month thereafter. You are obligated to make every Monthly Payment regardless of non- attendance, except where the cancellation terms below (or under the Principal Terms) are met. You are unable to amend the date of your Monthly payments.
If you fail to pay any monies due under this agreement or if any Payment is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay our Payment Provider on demand an administration fee of £25 (which our Payment Provider requires to cover our costs of seeking to pursue such payment from you).
You agree to advise us (allGym) promptly of any change to your agreement details that you provided upon joining.
If you fail to pay any amount due under this agreement for a period of more than thirty days, then our payment provider may pass the debt to a third-party company for collection. The reasonable and direct costs incurred in employing the third-party company will be borne by you including costs in tracing you if you have changed your address without telling us.
Once you have completed the Minimum No. Of Monthly Payments we will automatically continue collecting Monthly Payments every month. Your membership will be extended by one month for each payment (“Renewal Period”). This renewal payment amount may only be amended if we advise you in writing giving not less than 30 days’ notice.
If you have fulfilled your commitment to the membership you have joined, you may prevent the Automatic Renewal at any time by visiting the allGym website and submitting an online cancellation form (you should give us (allGym) not less than 30 days’ notice).
We will manage and process the cancellation of your membership upon receipt of a properly submitted cancellation request form either via the cancellation option in your allGym app or the allGym website. Should your payment method be cancelled at any time you may incur fees as a result of any missed payments. If you wish to have confirmation of any amendments to your account at any stage please contact our Member Enquiries team by visiting hello@allgym.co.uk.
CANCELLATION WITHIN CONTRACT
Relocation: This agreement can be cancelled in the event that your new permanent address is more than 10 miles away from any allGym facility upon receipt of a copy of a utility bill or bank statement showing the new address. Visit the allGym website and upload the relevant documents when you complete the online cancellation form.
Long term (over 3 month) illness or injury: This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided. Visit the allGym website and upload the relevant documents when you complete the online cancellation form.
Redundancy: This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood - Visit the allGym website and upload the relevant documents when you complete the online cancellation form.
Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given - Visit the allGym website and upload the relevant documents when you complete the online cancellation form.
Please note – ANY Cancellation for the above reasons will not be effected until the appropriate proof is provided and approved
Only cancellations submitted online via the website will be accepted
Breach: This agreement can be cancelled if we (allGym) are in breach of contract including if we do not provide facilities or services you may reasonably expect and we have fallen well below that standard.
12. FREEZING
You are able to freeze your membership for a continuous period of up to 3 months without charge, for any reason. We will allow a maximum of 3 months frozen membership in any one calendar year.
Temporary Illness or Injury: This agreement may be frozen for a maximum of 3 months in addition to the allowable 3-month freeze period as outlined above, in the event of a temporary illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time
All freeze requests must be submitted either via the allGym website or email and will not be effective until your request has been confirmed by our Payment Provider.
Once your freeze has been processed you will not have access to the facilities until the freeze period has come to an end.
Please note – A freeze period does not affect the Minimum No. of Monthly Payments you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a monthly basis once the freeze period has completed. (Freeze of payment must be submitted 14 working days before the Monthly payment is due to be taken, if the submission is too close to the payment date the following payment will be frozen).
Please note if your membership included the benefit of a free period then we (allGym) will stop making collections during that free period and recommence making collections on the renewal date.
13. GENERAL TERMS
The Monthly membership fee is due each month in full, upfront, in advance and with the exception of cancellations under the principal terms, no partial refund of the monthly membership fee will be made unless you are cancelling under cooling-off regulations detailed in Clause 1.
You agree to comply with the Rules of Membership which are displayed prominently in the Club and relate to opening hours, use of facilities and your conduct. We (allGym) may make reasonable changes to these Rules at any time provided we (allGym) give you reasonable advance notice of the change.
If we (allGym) take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
We (allGym) will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us (allGym) you must do so within the United Kingdom. Relevant UK law will apply.
If any part of this agreement is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.
We (allGym) may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules (i.e. Stealing or other criminal activities within the facility). In this event you will not be liable to pay any further Monthly Payments, provided such breach is not deemed by us (allGym) to have occurred primarily in order to qualify you for a refund.
By ticking the relevant boxes during the sign-up process you are agreeing to the contractual agreement. You will only be granted access to the facilities once you have activated your account and completed your PAR- Q health questionnaire.
14. PLUS MEMBERSHIP
As a PLUS member, you agree to:
Pay a higher fee for access to the exclusive features of the PLUS membership.

You must provide a 30-day notice for membership downgrades. If you previously enjoyed a discounted Membership rate before upgrading to a PLUS Membership, reverting to a standard Membership will mean forfeiting this discount. You will then be subject to the current standard Membership rate at the time of downgrade.
If a missed Direct Debit/Recurring Card Payment leads to arrears, your PLUS Membership priveleges, alongside standard Membership and gym access, will be temporarily paused until payment is resolved.
PLUS GUEST PRIVILEGES as part of the PLUS Memebership:
PLUS members may bring one guest per day for free. All guests must be 18 years old or at least 14 years old if accompanied by a parent/guardian and must sign a guest registry. Adult guests must present photo identification when signing in.
The PLUS member must accompany the guest, remain on the premises during the entire visit and depart at the same time.
PLUS guests are not entitled to any PLUS benefits or amenities.
PLUS members must be 18 years old to use the tanning facilities.
By Signing up to the PLUS membership at allGym, the member acknowledges and agrees to the following stipulations regarding guest privileges:
The PLUS membership entitles the member to bring a guest to allGym facilities during manned operating hours.
Your guest cannot be a current member of allGym at the time the PLUS Membership is initiated.
Your guest cannot have been a current member of allGym on or after 16/02/2024.
Guests must adhere to all rules regulations, and policies of allGym while on the premises and allGym reserves the right to refuse entry to any guest who fails to comply.
The member understands and agrees that violation of this stipulation may result in the suspension or termination of their PLUS Membership privileges without refund.
By signing up for the PLUS Membership the member acknowledeges that they have read, understood and agreed to abide by the guest stipulation clauses outlined above.
Gym Rules
• To complete the sign up process and become a allGym Member, you
must read this PDF including the Health Declaration and tick that you
agree. Membership will not be able to be processed unless the box has
been ticked in agreement.
• Our Members must use their QR code via the app or PIN number on
each visit to gain access to allGym.
• We use CCTV to monitor access and usage to ensure the safety and
security of our members.
• If your access is via a PIN number, this is solely for the use of yourself.
It may not be passed on to anyone else (we monitor all PIN number
usage and any misuse may result in the termination of membership).
• On joining allGym, we offer all our members a comprehensive
induction to instruct you on the safe use of the gym equipment. We
strongly advise you undertake this. allGym will not accept any liability for
any personal injury claim if you use the gym equipment having not
undertaken an induction from a qualified member of allGym staff.
• An Induction appointments can be made via the member login section
on the allGym website.
• If you are unsure at any time as to how to use any piece of equipment,
you must seek advice from a qualified member of allGym staff before
you use it.
• We ask you wear clean, tidy, none offensive gym kit and that you smell
fresh.
• We don’t allow you to train in attire such as jeans, work-wear, boots,
flip flops or sandals.
• Bags are not allowed on the gym floor. It looks untidy and can cause a
trip hazard.
• Lockers are provided for you to store your belongings for the duration
of your workout. Lockers will be emptied at night and members’ items
removed to lost property. Padlocks maybe broken to gain entry and will
not be replaced.
• Members are solely responsible for their own belongings whilst
attending allGym. We accept no responsibility for any loss or damage to
personal property.
• It’s worth bringing a sweat towel if you plan on working hard. No one
wants to sit on sweaty machine.
• Equipment should be put away when you’ve finished with it, so
someone else can use it.
• Please be mindful of not spending long periods of time on equipment if
someone is waiting for it.
• Be mindful of your language and manner. We don’t tolerate aggressive
or abusive behaviour. We reserve the right to contact the police if
necessary.
• Please ensure that you put your weights back in their original place
when finished, failure to do so may result in your membership being
terminated.
• Please do not misuse weights by dropping them on the floor. This may
result in your membership being terminated.
• You may not use allGym whilst under the influence of alcohol,
tranquilizers, narcotics or any medication/substance which may affect
your ability to exercise safely. allGym reserves the right to remove you
from the premises if it reasonable believes you are unfit to use the
facilities.
• You are not permitted to take photographs/videos on the premises or
post remarks to the internet that may identify another member.
• Only allGym licensed personal trainers are permitted to train members
in the gym. Anyone else undertaking members’ training will be asked to
leave the gym immediately.
• We do not take responsibility for any item held in lost property. These
items will be kept until claimed but for no longer than one week. After
one week, the items will either be donated to charity or destroyed.
• By accessing the gym and using the equipment, our members are
deemed to have read and understood the membership terms and
conditions.
• Members must inform allGym of any change of home address, email
address or telephone number. These changes can be made directly with
the gym staff on the PC’s or via email to the relevant gym.
• Members are advised to inform allGym of any change in medical health
that could affect their ability to exercise in the gym.
• We ask our members to come and see us for any help you need at all
whilst in the gym.
• Smoking (including e- cigarettes) is strictly prohibited in all areas of the
gym. Any member found to be in breach of this rule may have their
membership terminated.
• If you are attending a class or a personal training session, we ask that
you are on time. If you are late, the instructor or personal trainer is within
their rights to refuse you entry.
• Please be respectful when it comes to closing the gym. You’ll be asked
politely and respectfully to leave on time.
• Members may not bring any pets (other than guide dogs) onto the
premises.

customer, use our website and member services systems, you are
entrusting us with your most valuable asset—your data. You trust that its
privacy will be protected and that it will be used only in a way that is
consistent with your expectations.

allGym collects data to operate effectively and provide you the best

our member Wi-Fi, administer your member services account, book an
induction, request a one-day pass, or submit an enquiry via one of our

any additional restrictions imposed by the source of the data. These
third-party sources vary over time, but have included:

profiles.

to provide personal data, you may decline. But if you choose not to
provide data that is necessary to provide a product or feature, you
may not be able to use that product or feature.
The data we collect depends on the context of your interactions with
allGym, and the products and features you use. The data we collect can

• Name and contact data. We collect your first and last name, email
address, postal address, phone number and other similar contact
data.
• Credentials. We collect passwords, password hints and similar
security information used for authentication and account access.
• Demographic data. We collect data about you such as your age,
gender, location and training goals.
• Payment data. We collect data necessary to process your payment
if you make purchases, such as your payment instrument number
(such as a credit card number), and the security code associated
with your payment instrument.
• Usage data. We collect data about your training patterns and how
often you train at our gyms.
We also collect information you provide to us and the content of
messages you send to us, such as feedback and product reviews you
write, or questions and information you provide for customer support.
How we use personal data
Contact & Communication: We use data we collect to communicate with
you and personalise our communications with you. For example, we
may contact you by phone, SMS, email or other means to provide you
with information about the products / services that allGym offer, to inform
you that you have not completed your membership sign up process, to
invite you to provide feedback, or to send you our weekly email
newsletters. When sharing your data via one of our sign-up forms, you
can opt whether you would like to receive communications from allGym.
All emails* we send will provide the option for you to unsubscribe from
receiving marketing/informational communications. We may still contact
you by email or phone in the event of emergency, or if there is important
information about the gym (such as maintenance work).
*Email marketing campaigns published by allGym may contain tracking
facilities within the actual email. Subscriber activity is tracked and stored
in a database for future analysis and evaluation. Such tracked activity
may include; the opening of emails, forwarding of emails, the clicking of
links within the email content, times, dates and frequency of activity.
This information is used to refine future email campaigns and supply the
user with more relevant content based around their activity.
In compliance with GDPR, subscribers are given the opportunity to
unsubscribe at any time through an automated system. This process is
detailed at the footer of each email campaign. If an automated
unsubscription system is unavailable clear instructions on how to
unsubscribe will by detailed instead.
We partner with Harlands to make direct debit collections on our behalf
for members of our club in the UK. We share with Harlands all of the
information which is necessary to make these collections and in order for
them to be able to meet their obligations under the Direct Debit
Guarantee Scheme. Outside of the above, we will not share your data
with any third party.
Customer feedback: We use data from customer feedback to make
improvement to our products
Business Operations: We use data to develop aggregate analysis and
business intelligence that enable us to operate, protect, make informed
decisions and report on the performance of our business.

consider to be your own abilities.
2. We will take reasonable steps to make sure that our equipment and facilities are clean
and safe for you to use and enjoy for the normal purpose they were intended for. Bear in
mind that we are not able to clean or inspect equipment and facilities after each use.
3. We will take reasonable steps to make sure that our staff are qualified to Chartered
Institute for the Management of Sport and Physical Activity standards.
4. If you tell us you have a disability that puts you at a substantial disadvantage in terms of
accessing our equipment and facilities, we will consider which adjustments, if any, are
reasonable for us to make.
Your commitment to us
1. Do not exercise beyond your own abilities. If you know or are concerned that you have a

them. Exercise carries its own risks. When you are exercising, you are responsible for the

3. Let us know immediately if our equipment or facilities are unsafe to use or if you feel ill
when using our equipment or facilities. Our staff members are not qua lified doctors, but
there will be someone available who has been trained in first aid.
